1. Overview

Feason respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond to notices of alleged copyright infringement that comply with the DMCA and are properly submitted to us.

2. Filing a DMCA Notice

If you believe that content available on Feason infringes your copyright, you may submit a written notification containing the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, including the URL or other specific location on the Service where it can be found.
  • Your contact information, including your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.

3. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and where it previously appeared on the Service.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notification.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

4. Designated Agent

All DMCA notices and counter-notifications should be submitted through our community forum or by contacting us at the information provided on our Contact page. Please include “DMCA Notice” or “DMCA Counter-Notification” in the subject line.

5. Repeat Infringers

Feason will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers. We reserve the right to remove any content and terminate any account at our sole discretion if we determine that a user has repeatedly infringed the copyrights or other intellectual property rights of others.

6. Good Faith

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. We encourage you to consult with a legal professional before filing a DMCA notification or counter-notification.
